Privacy Statement
Vision Personal Training Franchises Pty Limited trading as "Vision Personal Training" (ACN 079 080 578) and its related companies, including Vision Virtual Training Pty Limited ("we", "us" or "Vision") are committed to ensuring the protection and security of your privacy. This privacy statement ("Privacy Statement") describes how we deal with personal information (including sensitive information), and the safeguards we have in place to protect your privacy in accordance with all applicable privacy laws, including the Privacy Act 1988 (Cth) the Australian Privacy Principles as well as the New Zealand Privacy Act 2020 and the Information Privacy Principles (“Privacy Laws”). This Privacy Statement also applies to personal information which is collected by the companies within our franchise network ("Franchisees") which operate Vision personal training studios.
This Privacy Statement forms part of, and is subject to, our general terms of use. By using our site or our MyVision App ("App"), or providing information to us, you indicate that you agree to the terms below.

We care about your privacy
Vision treats all personal information in accordance with the requirements of the Privacy Laws. We will never rent, trade or sell your email address or other information to anyone. We will never publicly display your email address or other personal details that may identify you.
What information do we collect?
Vision collects personal information from you when you send an enquiry, place an order, subscribe to our newsletter, subscribe as a user of our App, participate in a trial or sign up to become a client online or through a Vision personal training studio, register your interest in becoming a client with Vision or finding out more about what we offer, or get started in any of our health and fitness challenges. Vision will only collect information that is necessary for us to help you meet your health and fitness goals, including by the use of Vision's personal training services which are provided in person, online and through the App.
The information we may collect includes:
- Identity and Contact Data including your name, email address, residential and/or postal address, and phone number;
- Profile Data including your username and password for our services, profile picture, purchases or orders you have made with us, support requests you have made, content you post, send receive and share through our platform, information you have shared with our social media platforms, your interests, preferences, feedback and survey responses, and other information that you share with us in connection with your health, lifestyle, nutrition, and your personal fitness history and goals;
- Visual Data including photographs and videos of participants taken during group sessions or for "client of the week" features, which may be posted on our social media platforms with your consent;
- Financial Data including bank account and/or credit card details where you make a purchase from us, or agree to a trial or subscribe to our services through our website, or you join as a client online or through our studios;
- Transaction Data including details about payments to you from us and from you to us and other details of products and services you have purchased from us or we have purchased from you;
- Technical Usage Data including internet protocol (IP) address, your login data, your browser session and geo-location data, device and network information, statistics on page views and sessions, acquisition sources, search queries and/or browsing behaviour, information about your access and use of our website, including through the use of Internet cookies, your communications with our website, the type of browser you are using, the type of operating system you are using and the domain name of your Internet service provider;
- Data including your username and password for MyVision App, profile picture, purchases or orders you have made with us, content you post, send, receive and share through our platform, information you have shared with our social media platforms, and support requests you have made.
- Interactive Data including information you provide to us when you participate in any interactive features of our Services, including surveys, contests, promotions, activities or events; and
- Marketing and Communications Data including your preferences in receiving marketing from us and our third parties and your communication preferences.
- Professional data including where you are a worker of ours, applying for a role with us, or a franchisee of the Vision Personal Training franchise network your professional history such as your previous positions and professional experience, or whether you hold required authorisations or licences.
- Sensitive information is a sub-set of personal information that is given a higher level of protection. Sensitive information means information relating to your racial or ethnic origin, political opinions, religion, trade union or other professional associations or memberships, philosophical beliefs, sexual orientation or practices, criminal records, health information or biometric information. The types of sensitive information that we collect include your health and fitness information.
Your Financial Data will be retained by us for billing purposes relating to scheduled payments for your chosen subscriptions, or for any future purchases by you.
If you sign up for a trial or subscribe as a user to our App, then you will be asked to enter in payment information including credit card details through your account with the applicable app store through which you register for the trial or subscribe to the App (i.e. through in-app purchases). Any information submitted through the relevant app store will be dealt with in accordance with that store's applicable privacy policy.
You may also choose to make an inquiry with Vision or visit our site anonymously, or by using a pseudonym, however doing so may result in restrictions on the services which we are able to provide to you.
Children’s Privacy
Vision Personal Training recognises the importance of protecting the privacy of children. We do not knowingly collect personal information from individuals under the age of 18 years without the consent of a parent or guardian.
If you are under 18 years of age, please do not provide any personal information to us without the involvement and consent of a parent or guardian. If you believe that we may have collected personal information from someone under the age of 18 without parental consent, please contact us immediately using the details provided at the end of this Privacy Statement. We will take prompt steps to delete any such information or ensure the requisite consents are received to retain this information.
In cases where we offer services that may be of interest to children (such as specific fitness programs for young people), we will always require parental or guardian consent before collecting or using any personal information. Any such information will be handled with extra care and used solely for the purpose for which it was collected.
We encourage parents and guardians to take an active role in their children’s online activities and interests, particularly when it comes to the sharing of personal information. How does Vision collect information?
We may collect personal information that you provide to us about yourself when you:
- use our website (including when you purchase any products and/or services on or through the site, add reviews, forum or chat room messages or comments);
- sign up for a trial or subscribe as a user for our App (including when you purchase any products and/or services on or through the App, and submit, enter or otherwise upload information, materials and other content to or through the App, including comments, reviews, feedback or ideas);
- attend at any of the Vision personal training studios;
- contact a Vision personal training studio in other ways, such as by phone or online;
- provide information to us by email, telephone, online contact request or through marketing or competition application forms; or
- connect any third-party software to our App, including step and/or sleep tracking software.
Information which is provided to our personal training studios will collected by, and shared with us from the particular Franchisee who operates the relevant studio.
How we may use your personal information
Vision will use your personal information in various ways to help you achieve and maintain your personal health and fitness goals.
Personal information: We collect, hold, use and disclose your personal information for the following purposes:
- to enable you to access and use our software and the MyVision App, including to provide you with a login;
- to assess whether to take you on as a new client;
- to work with you as a customer or supplier of our business, including to dispatch and deliver our products to you, register your attendance at our events, assess your application, manage your appointments;
- to enable franchisees in the Vision Personal Training franchise network to contact or communicate with you for the provision of services;
- to contact and communicate with you about our business, including in response to any support requests you lodge with us or other enquiries you make with us;
- to contact and communicate with you about any enquiries you make with us via any website we operate;
- for internal record keeping, administrative, invoicing and billing purposes;
- for analytics, market research and business development, including to operate and improve our business, associated applications and associated social media platforms;
- for advertising and marketing, including to send you promotional information about our events and experiences and information that we consider may be of interest to you;
- to run promotions, competitions and/or offer additional benefits to you;
- to suggest products and services which may be of interest to you;
- if you have applied for employment with us, to consider your employment application or pass on your employment application to a franchisee for their direct consideration; and
- to comply with our legal obligations or if otherwise required or authorised by law.
Sensitive information: We only collect, hold, use and disclose sensitive information for the following purposes:
- any purposes you consent to;
- the primary purpose for which it is collected;
- secondary purposes that are directly related to the primary purpose for which it was collected, including disclosure to the below listed third parties as reasonably necessary to work with you as a customer or supplier of our business;
- to contact emergency services, or to speak with your family, partner or support person where we reasonably believe there is a serious risk to the life, health or safety of you or another person and it is impracticable for us to obtain your consent; and
- if otherwise required or authorised by law.
We may continue to share this information and offers with you even after you cease using our products and services. However, if you would prefer not to receive these communications from us, please let us know and we will respect your request. You may choose to stop receiving marketing or promotional communications from Vision at any time.
We may also use your personal information in relation to your activity and experience on the App, in order to:
- process any purchase which you make through or website or the App;
- respond to any queries or feedback that you may have;
- prevent and detect any misuse of, or fraudulent activities involving, our website or App;
- conduct research, analysis and development in respect of our systems, products and/or services; and
- maintain and develop our business systems and infrastructure, including testing and upgrading of our systems;
When may we disclose your information?
- Personal information: We will only disclose personal information (excluding sensitive information) to third parties where it is necessary as part of our business, where we have your consent, or where permitted by law. This means that we may disclose personal information (excluding sensitive information) to:
- our employees, contractors and/or related entities;
- franchisees of the Vision Personal Training franchise network;
- IT service providers, data storage, web-hosting and server providers;
- marketing or advertising providers;
- delivery or logistics providers who deliver our goods to you;
- professional advisors, bankers, auditors, our insurers and insurance brokers;
- payment systems operators or processors;
- our existing or potential agents or business partners;
- sponsors or promoters of any promotions or competition we run;
- if we merge with, or are acquired by, another company, or sell all or a portion of our assets, your personal information may be disclosed to our advisers and any prospective purchaser’s advisers and may be among the assets transferred;
- courts, tribunals and regulatory authorities, in the event you fail to pay for goods or services we have provided to you;
- courts, tribunals, regulatory authorities and law enforcement officers, as required or authorised by law, in connection with any actual or prospective legal proceedings, or in order to establish, exercise or defend our legal rights;
- third parties to collect and process data, such as analytics providers and cookies; and
- any other third parties as required or permitted by law, such as where we receive a subpoena.
- Sensitive information: We will only disclose sensitive information with your consent or where permitted by law. This means that we may disclose sensitive information to:
- our employees, contractors and/or related entities;
- franchisees of the Vision Personal Training franchise network;
- IT service providers, data storage, web-hosting and server providers;
- professional advisors;
- if we merge with, or are acquired by, another company, or sell all or a portion of our assets, your personal information may be disclosed to our advisers and any prospective purchaser’s advisers and may be among the assets transferred;
- courts, tribunals, regulatory authorities and law enforcement officers, as required or authorised by law, in connection with any actual or prospective legal proceedings, or in order to establish, exercise or defend our legal rights;
- third parties to collect and process data, such as analytics providers and cookies; and
any other third parties as required or permitted by law, such as where we receive a subpoena.In each case, Vision will only disclose information as is necessary to meet the required purpose. Before we disclose any information, Vision will also take reasonable steps to ensure that these third parties will be bound to protect and keep confidential all information which we provide to them at all times.
How do we keep your information secure?
Vision is committed to protecting the confidentiality of the information that you provide us and we will take all reasonable precautions to keep your personal information secure and safe from unauthorised use or alteration. Vision uses systems to store personal information in both electronic (on our computer systems and with our website hosting provider) and in hard-copy form. Vision has robust security systems in place in order to keep protected all information, including firewalls, anti-virus software and email filters, passwords, as well as internal policy requirements and physical security measures.
When you first set up an account to use our App, we will provide you with an option to enter your password each time you use the App, or you may also choose to enter your password initially when you set up your account on the App, and then remain logged into the App on your device until you log out. You can also change these options at any time. If you choose to remain logged in, then we strongly recommend that you ensure that your device is secured at all times by a password, biometric identifier or other secure logon requirements to ensure that your information in the app is kept secure. If you log out of the App, you will also be asked to re-enter your password the next time that you log back in.
For incoming enquiries, we use an automated SMS platform. No mobile information collected through this platform will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
Please notify us immediately if you believe at any time that your personal information has been altered through unauthorised use of your device.
Your obligations regarding personal information of others
You must not provide us with any personal information (including any health information) of any other person unless you have obtained their express consent to do so. If you do provide us with such information about another individual, before doing so you must tell that person that you will be providing their information to us, and that we will handle their information in accordance with this Privacy Statement, and provide that individual with a copy of (or refer them to) this Privacy Statement. By providing us with the personal information of others, you warrant to us that you have done this.
Re-marketing
Vision may sometimes use cookies or personal information in order to participate in re-marketing services. These services enable us to show advertisements and promotional offers on third party websites to individuals who we think may be interested based upon their activity and preferences previously indicated by using our website. These services enable us to tailor our marketing to better suit your needs, and to only display advertisements that we think may be relevant to you. Such advertising may be displayed on a search engine results page, or third-party website, or via social media. Search engines or social media organisations may use cookies and/or pixel tags to achieve this. Any data collected by those search engines or social media organisations will be used in accordance with their own respective privacy policies.
Overseas disclosure and transfer of personal information
Australian Residents
We store your personal information in Australia. Where we disclose your personal information to third parties, those third parties may store, transfer or access personal information outside of Australia, such as New Zealand, countries in the Asia Pacific, Europe and other. We will only disclose your personal information overseas in accordance with the Australian Privacy Principles.
New Zealand Residents
Where we disclose your personal information to third parties, those third parties may store, transfer or access personal information outside of New Zealand, which may not have an equivalent level of data protection laws as those in New Zealand. Before disclosing any personal information to an overseas recipient, we will comply with Information Privacy Principle 12 and only disclose the information if:
- you have authorised the disclosure after we expressly informed you that the overseas recipient may not be required to protect the personal information in a way that, overall, provides comparable safeguards to those in the Privacy Act 2020;
- we believe the overseas recipient is subject to the Privacy Act 2020;
- we believe that the overseas recipient is subject to privacy laws that, overall, provide comparable safeguards to those in the Privacy Act 2020;
- we believe that the overseas recipient is a participant in a prescribed binding scheme;
- we believe that the overseas recipient is subject to privacy laws in a prescribed country; or
- we otherwise believe that the overseas recipient is required to protect your personal information in a way that, overall, provides comparable safeguards to those in the Privacy Act 2020 (for example pursuant to a data transfer agreement entered into between us and the overseas recipient).

Employee Training and Privacy Commitment
Vision Personal Training is committed to maintaining the highest standards of privacy protection across all aspects of our operations. We recognise that our employees and franchisees play a crucial role in safeguarding your personal information. To this end, we have implemented comprehensive privacy training programs for all staff members and franchisees who handle personal information.
Our employee and franchisee training initiatives include:
- Regular privacy awareness sessions to keep our team and franchise network updated on current privacy laws and best practices;
- Specific training on our privacy policies and procedures in the context of employees and franchisees as business providers;
- Guidance on recognising and responding to potential privacy risks, especially in relation to Children’s Privacy; and

All new employees and franchisees undergo privacy training as part of their induction process, and we conduct refresher courses for existing staff and franchisees in the franchise network on an ongoing basis. This ensures that those in the business are vigilant and informed about their privacy obligations.
We also regularly review and update our internal policies and procedures to reflect any changes in privacy laws or emerging best practices. By fostering a culture of privacy awareness among our employees and franchisees, we aim to provide you with the highest level of confidence that your personal information is being handled with the utmost care and respect at all times.

Your rights and controlling your personal information
Your choice: Please read this Privacy Policy carefully. If you provide personal information to us, you understand we will collect, hold, use and disclose your personal information in accordance with this Privacy Policy. You do not have to provide personal information to us, however, if you do not, it may affect our ability to work with you as a customer or supplier of our business.
Information from third parties: If we receive personal information about you from a third party, we will protect it as set out in this Privacy Policy. If you are a third party providing personal information about somebody else, you represent and warrant that you have such person’s consent to provide the personal information to us.
Restrict and unsubscribe: To object to processing for direct marketing/unsubscribe from our email database or opt-out of communications (including marketing communications), please contact us using the details below or opt-out using the opt-out facilities provided in the communication.
Access: You may request access to the personal information that we hold about you. An administrative fee may be payable for the provision of such information. Please note, in some situations, we may be legally permitted to withhold access to your personal information. If we cannot provide access to your information, we will advise you as soon as reasonably possible and provide you with the reasons for our refusal and any mechanism available to complain about the refusal. If we can provide access to your information in another form that still meets your needs, then we will take reasonable steps to give you such access.
Correction: If you believe that any information we hold about you is inaccurate, out of date, incomplete, irrelevant or misleading, please contact us using the details below. We will take reasonable steps to promptly correct any information found to be inaccurate, out of date, incomplete, irrelevant or misleading. Please note, in some situations, we may be legally permitted to not correct your personal information. If we cannot correct your information, we will advise you as soon as reasonably possible and provide you with the reasons for our refusal and any mechanism available to complain about the refusal.
Complaints: If you wish to make a complaint, please contact us using the details below and provide us with full details of the complaint. We will promptly investigate your complaint and respond to you, in writing, setting out the outcome of our investigation and the steps we will take in response to your complaint. If you are not satisfied with our response, you may contact the Office of the Australian Information Commissioner (if you are an Australian resident), or the Office of the New Zealand Privacy Commissioner (if you are a New Zealand resident).
Storage and security
We are committed to ensuring that the personal information we collect is secure. In order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures, to safeguard and secure personal information and protect it from misuse, interference, loss and unauthorised access, modification and disclosure.
While we are committed to security, we cannot guarantee the security of any information that is transmitted to or by us over the Internet. The transmission and exchange of information is carried out at your own risk.
User-Generated Content
We may enable you to post reviews, comments, photos and other user-generated content. Any content you choose to submit will be accessible by anyone, including third parties not associated with us. We have no control over how others may use or misuse information you make publicly available. We are not responsible for the privacy, security or accuracy of any user-generated content you choose to post or for the use or misuse of that information by any third parties.
Cookies and Analytics
We may use cookies, tracking pixels and similar technologies on our website and in our emails from time to time. Cookies are text files placed in your computer's browser to store your preferences. Tracking pixels are tiny, invisible images (typically the size of one pixel) embedded in web pages or emails. Cookies and tracking pixels, by themselves, do not tell us your email address or other personally identifiable information. However, they do recognise you when you return to our online website and allow third parties to cause our advertisements to appear on your social media and online media feeds as part of our retargeting campaigns. Cookies may also be used within our App for the purpose of authenticating users for security purposes, or to cache profile data in order to maximise speed and performance when using the App.
If and when you choose to provide our online website with personal information, this information may be linked to the data stored in the cookie or collected by tracking pixels. Unlike cookies, tracking pixels do not store any information on your device, but instead send information to our servers when the pixel is loaded.
You can block cookies by activating the setting on your browser that allows you to refuse the setting of all or some cookies.
You can block tracking pixels by using ad-blocking or privacy-focused browser extensions. Some email providers allow you to block images by default, which can prevent tracking pixels in emails from loading.
However, if you use your browser settings to block all cookies (including essential cookies) and tracking pixels you may not be able to access all or parts of our website and you may not receive personalised content.
- Google Analytics: We may use Google Analytics Advertising Features. We and third-party vendors may use first-party cookies (such as the Google Analytics cookie) or other first-party identifiers, and third-party cookies (such as Google advertising cookies) or other third-party identifiers together. These cookies and identifiers may collect Technical and Usage Data about you.
- You can opt-out of Google Analytics Advertising Features including using a Google Analytics Opt-out Browser add-on found here. To opt-out of personalised ad delivery on the Google content network, please visit Google’s Ads Preferences Manager here or if you wish to opt out permanently even when all cookies are deleted from your browser you can install their plugin here. To opt out of interest-based ads on mobile devices, please follow these instructions for your mobile device: On Android open the Google Settings app on your device and select “ads” to control the settings. On iOS devices with iOS 6 and above use Apple’s advertising identifier. To learn more about limiting ad tracking using this identifier, visit the settings menu on your device.

Facebook/Meta Analytics: We may use tools provided by Meta, such as the Meta Pixel, advanced matching, and Conversions API. These allow us to measure ad performance and deliver ads that may be relevant to you on Meta platforms based on your activity on our website/app. You can control whether we can join data from third party partners with your Meta account for ads by adjusting your preferences within Meta's settings. You can disconnect this data from your Meta account by changing your settings for Off-Facebook activity. For more information, please see Meta's Privacy Policy here.
Vision may also collect Internet Protocol (IP) addresses. IP addresses are assigned to computers on the internet to uniquely identify them within the global network. Vision may collect and manage IP addresses as part of the service of providing internet session management and for security purposes. We may also collect and use web log, computer and connection information for security purposes and to help prevent and detect any misuse of, or fraudulent activities involving our website or App.
Links to other websites
Our website may contain links to other party’s websites. We do not have any control over those websites and we are not responsible for the protection and privacy of any personal information which you provide whilst visiting those websites. Those websites are not governed by this Privacy Policy.
Personal information from single sign-on accounts
If you connect your account with us using a single sign-on account, such as Apple, Facebook or Google, we will collect your personal information from the single sign-on provider. We will do this in accordance with the privacy settings you have chosen with that provider.
The personal information that we may receive includes your name, ID, user name, handle, profile picture, gender, age, language, list of friends or follows and any other personal information you choose to share.
We use the personal information we receive from the single sign-on provider to create a profile for you on our platform and App.
Where we have accessed your personal information through your Facebook account, you have the right to request the deletion of personal information that we have been provided by Facebook. To submit a request for the deletion of personal information we acquired from Facebook, please send us an email at the address at the end of this Privacy Policy and specify in your request which personal information you would like deleted. If we deny your request for the deletion of personal information, we will explain why.
Use of location services data
- We collect your precise or approximate location via our App for the following purposes:
- to enable you to pick up deliveries and to deliver them to our client’s customers;
- to generate routes and improve routes via the data collected;
- to allow the warehouse to monitor the vehicle location within their account dashboard;
- to allow our client to access order location in real time;
- for security and safety;
- to prevent and detect fraud; and
- as permitted by law.
- We collect this information when you enable our App to use your device’s location services. If you do not want us to use your location for the purposes above, you should turn off the location services in your mobile phone settings. If you do not provide geolocation data to us, it may affect our ability to work with you as a customer or supplier of our business.
Use of Google API Services (this section applies to personal information accessed through Google API Services).
We use Google’s Application Programming Interface (API) Service to access your information to enable you to use our app and track your progress.
Our use of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements (set out in the Google API Services User Data Policy).We limit our use of the personal information that we collect to providing or improving our Services. We do not use the personal information for any other purposes.
We only transfer the personal information to others if it is necessary to provide or improve our Services or as necessary to comply with applicable law or as part of a merger, acquisition or sale of assets where we notify you of this.
We do not use or transfer the personal information for serving ads, including retargeting, personalised or interest based advertising.
These restrictions apply to the raw data we obtain from the restricted scopes and data that is aggregated, anonymised or derived from them.
We have policies and procedures in place setting out appropriate safeguards for protecting your personal information obtained with the Google APIs. We will also ensure that our employees, agents, contractors and successors comply with the Google API Services Data Policy.
Third-party websites
Sometimes, we may offer you an option to click-through to selected third party websites from our website or App which we think may be of interest to you. If you choose this option, we suggest that you refer to the privacy statement that applies to those websites. This Privacy Statement only applies to our website and App, and Vision will not have any responsibility in respect of any third-party website.
Changes to our Privacy Statement
From time to time, it may be necessary for us to revise our Privacy Statement. Any changes which we make will be in accordance with the requirements of the Privacy Laws. We may notify you about changes to this Privacy Statement by posting an updated version on our website or the App.
